Welcome to the “TBC Pay” website.

For both you and TBC Pay, the terms of this agreement (the “Agreement”) are binding.

These terms and conditions should be carefully read.

By using this website, you automatically agree to be bound by the terms of this Agreement and are bound by all of the terms below that govern your use of our service and other terms of service. You must stop using our service right away if you disagree with the terms of the Agreement.

Please note that in addition to the general terms and conditions, there may be different and specific rules for receiving a specific service, which you will receive information about in the process of receiving a specific service. In the event of any inconsistency between the General Terms and the Special Terms, the terms of this Agreement shall prevail.

Definition of Terms

We – TBC Pay LLC, hereinafter tbcpay.ge;

You – the person (natural person; legal entity on whose behalf the natural person acts) entering the website;

Services – electronic payment services;

Agreement - this document;

Beneficiary – the person in whose favor the payment is made;

When using the website, you:

  • confirm that you are an adult with legal capacity, or a person who has reached the age of 16, and you have permission from the relevant persons (legal representative) to enter into this Agreement and receive online payment services through the website and dispose of the relevant funds;
  • during log in to the website, you provide accurate and truthful information in order to use our services;
  • during authorization on the website, information is provided at your own will and for this you have the right/permission stipulated by the legislation or the agreement.
  • Confirm that we have the right to retain the information you provide for the purpose of creating a transaction history and for other purposes of website operation.
  • will protect copyright and intellectual rights. will not copy and distribute all or any part of the information on the website, in any form and for any purpose;
  • will protect the security and privacy of your personal account during authentication. will not disclose to any third party the security data of the profile created during your authorization in order to protect the information in your personal account;
  • will not take any action that endangers the proper functioning of the website.

“TBC Pay” is a company whose purpose is to enable electronic payments (“Service”) through the website, namely www.tbcpay.ge.

offer payment services, wherein funds are received from the payer exclusively for the purpose of transferring them to the recipient or another payment service provider acting on their behalf; alternatively, funds may be received on behalf of the recipient, with the assurance that the recipient will have access to them.

Use of the website

By making a payment, you confirm that you agree to pay for a specific recipient's service or product. You can make any payment through your bank card.

Registering at “tbcpay.ge" gives you the opportunity to have your own profile, which, unlike a regular user, allows you to view the history of payments, create payment templates and, most importantly, make payments more easily because you won't have to reenter the necessary information for identification/verification.

You confirm that you have all necessary rights, permissions to use and authorize us to use any information you provide in accordance with this Agreement and the Privacy Policy;

Receiving services

Our service is available through the website in Georgia.

We reserve the right, in our sole discretion, to disallow or otherwise limit access to our services for specific individuals.

Also, we reserve the right to refuse you in a specific case, regarding a specific payment, based on the standards established by the National Bank for payment service providers.

By receiving a service, you confirm to pay for a specific recipient's service or product. As soon as a specific payment is confirmed, you will choose the desired payment form and the corresponding amount will be blocked on the bank card or account. If there is a defect, if the service is not provided on time, we will contact the recipient through which the payment was made and send a request to eliminate the defect.

Obligations

You are obliged to inform us of the fact of loss, theft, illegal appropriation or illegal use of the payment instrument (account, code, password and other data necessary for making the payment) as soon as possible after its discovery. Otherwise, you are fully responsible for any damages caused by intention or negligence.

You are obliged to observe the security measures of the payment instrument, to ensure the protection of the personalized means of this account.

We are obliged to take all possible measures to ensure the security of your payment instrument and to prevent its improper use, not to make the personalized security features and facilities of the account available to other persons than their owner and to inform you of the security requirements of the account;

In case of receiving a notification of the discovery of the fact of loss, theft, illegal appropriation or illegal use of a payment instrument (account, code, password and other data necessary for making a payment), we confirm receipt of the notification if no more than 18 months have passed since the notification was received. Upon receipt of the notification by the user, we will immediately ensure the prevention of further use of the payment instrument.

Liability Restriction

We are responsible and liable for the operation of this website only if it is caused by our intentional act.

You are fully responsible for the correctness and completeness of the details you provide us with the payment order.

Limits

If you are an unidentified user, you can make a one-time payment within the territory of Georgia, which does not exceed 1500 (one thousand five hundred) GEL or its equivalent in foreign currency.

Complaints and notification of an unauthorized or incorrectly executed payment transaction

You have the right to request from us a refund of the amount corresponding to the unauthorized or incorrectly executed operation, in the event that more than 13 months have passed since the account was debited with the amount of the unauthorized or incorrectly executed operation and you notify us of such operation without undue delay after the discovery of the unauthorized or incorrectly executed operation.

In case of unauthorized or incorrectly executed payment, you can contact us on the hotline: (+032) 2 27 27 27, to notify us of an unauthorized or incorrectly performed operation and provide us with the following information: The requisites specified for making the payment (e.g. personal number, subscriber number, etc., which you enter on the selected payment service), the amount of the deposited amount and the name of the recipient, in whose favor the payment was received.

You have the right to file a complaint with us in any format you choose (written, oral, or email) regarding any payment you made using our system. Within 15 (fifteen) working days (which may be extended by up to 20 calendar days), TBC Pay will review the complaint.

Based on the legislation and this agreement, we make a decision on the refund/non-refund of the amount paid, which will be notified to you. In case of positive decisions, we will inform you of the relevant information, on the basis of which you will be able to receive the money. If you wish, the money can be transferred to the account/mobile phone number you have suggested.

You have the right to file a complaint against the payment service provider with the National Bank of Georgia dispute resolution commission no later than 6 months from the date of filing a complaint with TBC Pay, in case of non-satisfaction (including non-response) or partial satisfaction of the complaint submitted by you to TBC Pay.

You have the right to apply to the commission if your claim does not exceed 50,000 GEL or the equivalent of 50,000 GEL in foreign currency. After receiving the complaint, the commission has 90 calendar days to review the dispute and render a decision (which may be extended by 30 days). The commission considers the dispute free of charge.

You have the right to apply to the court, even without applying to the commission.

Limitations on the use of the website

We do not guarantee that the online payment service through this website will operate without errors or interruptions.

The delay in entering the website can be caused by: Failure of computers, servers, networks, telecommunications lines, communications and other equipment.

Also, system overload, damage caused by acts of God, bad weather, accident, war, riot, rebellion, act of terrorism, restrictions imposed by government or law, court orders or any other cause beyond our control and caused by our fault.

In such cases, please note that you may not be able to receive the service and the payment may be unsuccessful. Therefore, please refrain from using the website/accepting online payment services. In case, despite the mentioned circumstances, you still continue to use the website, you are responsible for the consequences and the risk.

Information processing

When using our services, we get/receive the following types of information:

  • Name and surname;
  • Personal number;
  • Unique features and/or copy of ID card, passport, the same electronic document;
  • Personal email address;
  • Telephone number;
  • Contact list;
  • Legal/actual address;
  • Requisites of bank accounts;
  • Other information that also collectively allows for the personal identification of a person and/or is required for the purposes of attempting to interact with the Company or ultimately entering into a transaction.
We have the right to disclose and transfer the information you provide on the website:
  1. to any person affiliated with us and their authorized representative;
  2. to any other person or organization with your consent;
  3. to the relevant person or body, in the event of the right or obligation to provide information in the case provided by law, such as court, arbitration and others.

We have the right to process your personal data in accordance with Article 5, Clause “a” of the Law of Georgia on Personal Data Protection, in order to provide you with services.

Your use of this website or the provision of any information constitutes your consent to such transfer of information.

You understand that at any time you can partially or completely refuse consent or withdraw consent already given, you can request to receive additional information about the personal data processed about you by contacting the following e-mail address:callcenter@tbcpayge.ge Also, you have the right to request data correction, update, addition, blocking, deletion, destruction, restriction of processing, termination of processing and transfer of data.

You acknowledge that revoking your consent does not affect the lawfulness of data processing based on consent prior to revoking.

When we authorize you, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information.

Personally Identifiable Information

Personally identifiable information is information that identifies a specific user, for example: Your first and last name, personal number, email address, gender and date of birth, card number, expiration date, authentication code, transaction history or other relevant information.

Non-Personally Identifiable Information

Non-personally identifiable information is that which does not identify a specific user. You may change any of your personally identifiable information by logging into the appropriate section of your profile on the Website.

Final Provisions

Amendments to this agreement can be made by publishing them on the website www.tbcpay.ge which will come into force 1 (one) calendar month after its publication.

Any changes made to the terms of the agreement will be deemed to be agreed with you, unless you opt out of the planned change before the change takes effect. Before the changes take effect, you have the right to terminate this Agreement immediately without payment of any fees, costs or penalties.

If you reject the changes, we are entitled to terminate this Agreement after the effective date of the changes.

You have the right to terminate this Agreement at any time by giving us 30 (thirty) calendar days' notice.

This Agreement shall remain in effect until terminated by either party.

By agreeing to this Agreement and receiving our services through the website, it is considered that the agreement was concluded in Georgia, namely in Tbilisi, and in case of a dispute, it will be considered by the Tbilisi City Court, in accordance with the legislation of Georgia.

You may not assign this Agreement or the rights and obligations granted to you under this Agreement, in whole or in part, to a third party without our prior written permission.

Any attempt to do so by you will be void.
